These Terms of Service (“Terms”) govern your access to and use of Movingto.com and related services, content, and applications (the “Services”) provided by Moving To Global Pte. Ltd. (“Movingto,” “we,” “us,” or “our”). By using the Services you agree to these Terms. For consumers in the EEA/UK, additional rights apply (see Section 16).
1. Definitions
- Movingto Services
- Full-service immigration, residency, citizenship, and case-management services, including route strategy, legal work where included, evidence planning, document control, NIF and banking support, scheduling, deadlines, communication, and post-approval support, as stated in your written scope.
- In-House Legal Team and Other Professionals
- For Portugal matters, Movingto's in-house licensed Portuguese immigration lawyers handle immigration legal advice, filings, and representation within scope. Named tax advisers and regulated investment advisers remain responsible for those separate professional scopes under the applicable engagement terms.
- Third-Party Providers
- External organizations introduced or used in your matter (e.g., funds, banks, custodians, notaries, translators, couriers).
- Information-Only Materials
- Guides, comparisons, and the fund directory that compile facts without recommendations or suitability opinions.
- Payment Agent
- Where stated, Movingto’s role when we collect fees from you and pass them through to other named professionals or Third-Party Providers.
- Fund Directory
- Our facts-only listing of investment funds for residency eligibility screening; it is not a prospectus or a recommendation.
2. Scope of Services (What We Do)
Movingto provides full-service immigration, residency, citizenship, and case-management services. For Portugal, your written scope identifies the services included, the dedicated Case Lead responsible for the wider process, and Movingto's in-house licensed Portuguese immigration lawyer assigned to the matter. It separately identifies any other professional responsible for a tax, investment, employment, or other regulated scope.
For Portugal matters, Movingto's in-house licensed Portuguese immigration lawyers handle immigration legal advice, filings, and representation within the agreed professional scope and engagement terms. Tax advice and regulated investment advice are provided only by the appropriately qualified professional responsible for that separate scope.
2.1 Regulated Advice and Information-Only Materials
FOR PORTUGAL MATTERS, IMMIGRATION LEGAL ADVICE IS PROVIDED BY MOVINGTO'S IN-HOUSE LICENSED PORTUGUESE IMMIGRATION LAWYERS WITHIN THE AGREED SCOPE. REGULATED TAX OR INVESTMENT ADVICE IS PROVIDED ONLY BY THE APPROPRIATELY LICENSED PROFESSIONAL RESPONSIBLE FOR THAT SEPARATE WORK.
INFORMATION-ONLY MATERIALS (INCLUDING THE FUND DIRECTORY) ARE NOT RECOMMENDATIONS OR SUITABILITY OPINIONS AND MUST NOT BE RELIED UPON AS ADVICE.
3. In-House Legal Team, Other Professionals & Third-Party Providers
For a Portugal matter, your written scope identifies the licensed Portuguese immigration lawyer from Movingto's in-house legal team assigned to the case and any named tax or investment professional responsible for those separate scopes. Each professional retains responsibility for their advice, filings, representation, professional judgment, registration, and required insurance under the applicable engagement terms.
Third-Party Providers (e.g., funds, banks, translators) are separate from Movingto. We do not warrant or control their services.
4. Payments, Retainers, and Commissions
- Collection by Movingto. You authorize Movingto to collect payments for (a) the Movingto Services in your written scope, including in-house Portuguese immigration legal services where stated, and (b) where applicable, as Payment Agent for other named professionals and Third-Party Providers. Receipt by Movingto in that capacity is deemed receipt by the relevant provider.
- Lawyers’ fees. For Portugal matters, your quote or written scope identifies the immigration legal work included in the Movingto fee, Movingto's in-house licensed Portuguese immigration lawyer assigned to the matter, and any applicable engagement terms. That lawyer remains professionally responsible for legal services within that scope.
- Tax services. Where we collect fees for tax work, we do so as Payment Agent for the tax adviser. The tax adviser is solely responsible for tax advice and filings.
- Fund commissions. For introductions to funds or related providers, Movingto may receive referral fees or commissions from sponsors. We do not provide investment advice, suitability assessments, or recommendations. Commission arrangements do not increase the fees you pay to the fund. A summary of our referral-fee policy is available on request.
5. No Reliance; Your Responsibilities
- For Portugal matters, Movingto's in-house licensed Portuguese immigration lawyers provide case-specific advice within the agreed written scope. General website guides, comparisons, checklists, and summaries are information and do not replace that advice.
- For Portugal immigration legal decisions and filings, rely on the in-house Movingto lawyer assigned within the written scope. For tax or investment decisions, rely on the named adviser responsible for that separate regulated scope.
- Provide accurate, complete information; comply with KYC/AML requests; and keep your contact and payment details current.
6. Fund Directory & Introductions (Information Only)
The Fund Directory compiles publicly available and sponsor-provided facts (e.g., fees, auditors, liquidity terms). It is not an offer, solicitation, rating, or recommendation. Past performance is not indicative of future results. You must obtain independent investment advice.
7. Fees, Billing, and Taxes
- Fees will be set out in invoices or order pages. You agree to pay all invoiced amounts and applicable taxes.
- We may suspend services for non-payment. Late amounts may accrue interest at the lesser of 1.5% per month or the maximum permitted by law.
8. Intellectual Property
- All rights in the Services and our content belong to Movingto or its licensors. No rights are granted except as expressly stated.
9. License to Use the Services
- We grant you a limited, revocable, non-transferable license to access and use the Services for personal or internal business purposes.
10. User Content & Confidential Documents
- Ownership. You retain ownership of your User Content and documents.
- Public content. For content you intentionally submit for publication (e.g., testimonials, forum posts), you grant us a limited license to host and display it until you remove it.
- Case documents. Identity, financial, and source-of-funds documents are treated as confidential and used only to provide the Services and comply with law (e.g., KYC/AML). We will not use them for marketing without your explicit consent.
11. Third-Party Links and Services
Links to third-party sites or services do not imply endorsement. We are not responsible for their content, policies, or actions.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE GOVERNMENT PROCESSING TIMES, APPROVALS, RENEWALS, OR CITIZENSHIP OUTCOMES.
REGULATED LEGAL, TAX, OR INVESTMENT ADVICE IS PROVIDED ONLY BY THE APPROPRIATELY LICENSED PROFESSIONAL RESPONSIBLE FOR THAT WORK, WHO REMAINS RESPONSIBLE FOR THAT ADVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVINGTO IS NOT LIABLE FOR (A) ANY ACTS, ERRORS, OR OMISSIONS OF THIRD-PARTY PROVIDERS; (B) TAX ERRORS OR INVESTMENT LOSSES ARISING FROM SEPARATELY PROVIDED ADVICE OR SERVICES; OR (C) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. NOTHING IN THESE TERMS LIMITS A LICENSED PROFESSIONAL’S RESPONSIBILITY UNDER APPLICABLE LAW OR PROFESSIONAL RULES.
SUBJECT TO NON-WAIVABLE STATUTORY RIGHTS, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE MOVINGTO SERVICES IS LIMITED TO THE FEES YOU PAID TO MOVINGTO FOR THOSE SERVICES IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Nothing excludes liability for fraud, wilful misconduct, or death/personal injury caused by negligence, and nothing limits your non-waivable consumer rights.
14. KYC/AML & Sanctions
We may conduct KYC/AML, sanctions, and adverse-media checks and may refuse, suspend, or terminate services where required by law.
15. Termination
- We may suspend or terminate access for breach, legal risk, or non-payment. Upon termination, your right to use the Services ceases.
16. EEA/UK Consumers – Your Rights
- Cooling-off. If you are a consumer in the EEA/UK purchasing services online, you generally have a 14-day right to withdraw, unless you expressly request early performance and acknowledge you will lose the right once the service is fully performed.
- Local protections. Mandatory consumer protection laws of your country of residence apply and prevail over conflicting terms. You may bring proceedings in your local courts.
- ODR platform. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr/.
17. Governing Law & Dispute Resolution
- Business users & non-EEA/UK consumers: These Terms are governed by Singapore law. Disputes will be resolved by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in English before a single arbitrator in Singapore. Class/collective actions are waived.
- EEA/UK consumers: This Section does not limit your mandatory rights to local courts and laws. Any arbitration or class-action waiver applies only to the extent permitted by your local law.
18. Changes to the Services or Terms
We may update the Services or these Terms. We will post changes with a new effective date and notify you where legally required. Continued use after changes constitutes acceptance.
19. Privacy
Your use of the Services is also governed by our Privacy Policy. We process personal data to provide the Services and comply with law.
20. Notices
- We may provide notices via the Website or email. You consent to receive electronic communications.
21. Miscellaneous
- Assignment: We may assign these Terms; you may not assign without our consent.
- Force Majeure: Neither party is liable for delays due to causes beyond reasonable control.
- Severability/Waiver: If any provision is invalid, the remainder stays effective. Failure to enforce is not a waiver.
- Entire Agreement: These Terms constitute the entire agreement for the Services.
22. DMCA and Takedown
If you believe content infringes your rights, contact us via this form with your contact details, identification of the material, and a statement made under penalty of perjury that you have a good-faith belief the use is unauthorized.
